THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER RIGHTS, WHICH VARY FROM STATE TO STATE.

WE WARRANT THAT DURING THE WARRANTY PERIOD, THE PRODUCT WILL BE FREE FROM DEFECTS IN MATERIALS AND WORKMANSHIP.
WE LIMIT THE DURATION AND REMEDIES OF ALL IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE TO THE DURATION OF THIS EXPRESS LIMITED WARRANTY.
SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
OUR RESPONSIBILITY FOR DEFECTIVE GOODS IS LIMITED TO REPAIR AND/OR REPLACEMENT AS DESCRIBED BELOW IN THIS WARRANTY STATEMENT.
This Limited Warranty Policy ("Warranty") applies exclusively to the MitoCollar™ electronic device ("Device") and is issued by Erchonia Corporation ("Erchonia," "we," "us," or "our"). This Warranty is incorporated by reference into, and forms part of, the MitoCollar™ Terms & Conditions of Use. This Warranty is non-transferable and extends only to the consumer who originally purchased the Device. It does not extend to any subsequent owner or other transferee of the Device.
DEFINITIONS
"Device" means the MitoCollar™ electronic unit containing the laser light therapy components and Bluetooth circuitry, excluding all accessories.
"Accessories" means all items that are not part of the Device itself, including but not limited to: collars, wearable components, straps, charging cables, power adapters, carrying cases, and user documentation.
"Normal Use" means use of the Device in accordance with the instructions provided in the user manual and for the intended purpose of providing low-level light therapy to animals, without modification, alteration, or misuse.
1. WARRANTY DESIGNATION AND SCOPE
1.1 Warranty Coverage — First Year (12 months)
Erchonia warrants that the Device shall be free from defects in materials and workmanship under Normal Use for a period of one (1) year from the original date of purchase ("Warranty Period"). The Warranty Period is not extended if we repair or replace the Device. We may change the availability of this Warranty at our discretion, but any changes will not be retroactive.
This Warranty applies solely to the Device and expressly excludes all Accessories.
If a defect covered under this Warranty is confirmed by Erchonia within the Warranty Period, Erchonia shall, at its sole discretion:
• Provide a replacement Device at no charge (one replacement per defect occurrence);
• Provide a prepaid return shipping label for the defective Device; and
• Provide shipping of the replacement Device at no cost within the contiguous 48 United States, Alaska, and Hawaii.
Additional shipping, handling, duties, or related charges may apply for locations outside the United States.
1.2 Post-Warranty Replacement Option
Following expiration of the Warranty Period, customers with an active MitoCollar™ membership may be eligible for a paid replacement option ("Post-Warranty Replacement").
Eligibility for Post-Warranty Replacement requires:
• An active MitoCollar™ membership at the time of the replacement request; and
• Continuous membership status without lapses exceeding 30 days for a minimum of twelve (12) consecutive months immediately preceding the reported issue.
Under Post-Warranty Replacement:
• A replacement Device may be provided in exchange for a $99.00 replacement fee;
• The $99.00 fee includes standard shipping and handling within the contiguous 48 United States, Alaska, and Hawaii only; and
• Additional shipping and handling charges may apply for locations outside the United States.
If your Device version has been discontinued or superseded by a newer model, Erchonia may offer a newer version as a replacement. Upgrade fees ranging from $0 to $1,000, depending on model differences, may apply and will be disclosed to you prior to shipment. You may decline the upgrade.
The Post-Warranty Replacement option is not insurance, does not constitute an extension of the original Warranty Period, and does not create a new Warranty Period. Any replacement Device provided under Post-Warranty Replacement is provided "as-is" and remains subject only to this Post-Warranty Replacement option if future issues arise.
All pricing, fees, and charges described in this Warranty are subject to change at Erchonia’s discretion.
2. ADVANCE REPLACEMENT AND INSPECTION
Erchonia operates an advance replacement process to minimize downtime. Upon approval of a warranty or replacement request:
• A prepaid return shipping label will be provided to you;
• A replacement Device will be dispatched once carrier tracking confirms your return shipment is in transit, prior to our receipt of the returned Device.
Upon receipt, all returned Devices will be inspected by Erchonia to verify the reported issue and determine eligibility under this Warranty or Post-Warranty Replacement option.
If inspection reveals that the Device was:
• Intentionally damaged, altered, or modified;
• Subjected to misuse, abuse, or negligence; or
• Not defective as reported;
then Erchonia will notify you by email and/or phone upon inspection completion. You will be responsible for applicable charges, which may include:
• Device replacement cost (current retail price);
• Outbound and return shipping costs; and
• Any applicable upgrade fees.
You will have 10 business days from notification to either: (a) accept the charges and retain the replacement Device, or (b) return the replacement Device for a refund of any fees paid, less costs, if any, to repair damage to the replacement Device beyond normal wear and tear. If you do not respond within 10 business days or fail to return the replacement Device, Erchonia reserves the right to suspend membership services until the matter is resolved.
3. REPLACEMENT DEVICES
Replacement Devices may be new, refurbished, or remanufactured units of equal or greater functionality, at Erchonia's sole discretion. All replacement Devices are tested and certified to meet Erchonia's quality standards.
Replacement Devices do not extend, renew, or restart the original Warranty Period. The warranty status of a replacement Device is governed by the original purchase date of the first Device.
All returned Devices become the property of Erchonia and will not be returned to you.
4. EXCLUSIONS AND LIMITATIONS
4.1 What Is Not Covered
This Warranty does not cover:
• Accessories, including pet collars, straps, charging cables, power adapters, or cases;
• Defects or damage due to: improper use; failure to follow the product instructions or to perform any preventive maintenance; normal wear and tear; or external causes such as accidents, abuse, or other actions or events beyond our reasonable control;
• Unauthorized modification, alteration, disassembly, or repair by anyone other than Erchonia or an authorized service provider;
• Cosmetic damage that does not affect Device functionality, including scratches, dents, or discoloration;
• Loss or theft of the Device;
• Damage caused by use with non-Erchonia accessories or unauthorized third-party products;
• Defects arising from exposure to extreme temperatures, corrosive materials, or environmental conditions beyond normal household use; or
• Use of the Device in any manner inconsistent with its intended purpose as a pet wellness device.
4.2 Examples of Misuse
For clarity, "misuse" includes but is not limited to:
• Submerging the Device in water or other liquids;
• Dropping, crushing, or subjecting the Device to physical impact;
• Using incompatible charging equipment;
• Opening the Device casing or attempting internal repairs.
5. WARRANTY CLAIM PROCEDURE
To initiate a warranty claim or replacement request:
• Contact Erchonia support at support2@mitocollar.com;
• Provide proof of purchase (order confirmation, receipt, or invoice);
• Provide the Device serial number (located on the Device or in the mobile app);
• Describe the defect or issue in detail; and
• Follow all return instructions provided by Erchonia support.
Failure to comply with the return instructions, including failure to return the Device within 30 days of receiving the return label, may result in denial of the warranty claim and charges as described in Section 2.
Erchonia will make reasonable efforts to respond to warranty claims within 3 business days of receipt.
6. LIMITATION OF LIABILITY
THE REMEDIES DESCRIBED ABOVE ARE YOUR SOLE AND EXCLUSIVE REMEDIES AND OUR ENTIRE LIABILITY FOR ANY BREACH OF THIS LIMITED WARRANTY. OUR LIABILITY SHALL UNDER NO CIRCUMSTANCES EXCEED THE ACTUAL AMOUNT PAID BY YOU FOR THE DEFECTIVE DEVICE, NOR SHALL WE UNDER ANY CIRCUMSTANCES BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES OR LOSSES, WHETHER DIRECT OR INDIRECT, INCLUDING BUT NOT LIMITED TO: LOSS OF USE, LOSS OF PROFITS, LOSS OF DATA, COSTS OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES, OR INJURY TO PERSONS OR PROPERTY, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, EVEN IF ERCHONIA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
7. FORCE MAJEURE
Erchonia shall not be liable for any delay or failure to perform its obligations under this Warranty due to causes beyond its reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, pandemics, labor disputes, governmental actions, supplier failures, or disruptions in transportation or communication networks.
8. SEVERABILITY
If any provision of this Warranty is held to be invalid, illegal, or unenforceable under applicable law, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if such modification is not possible, the provision shall be severed from this Warranty. The remaining provisions shall continue in full force and effect.
9. GOVERNING LAW AND DISPUTE RESOLUTION
This Warranty shall be governed by and construed in accordance with the laws of the State of South Carolina, without regard to its conflict of law principles.
Any disputes arising out of or relating to this Warranty shall be resolved in accordance with the dispute resolution procedures set forth in the MitoCollar™ Terms & Conditions of Use.
10. ENTIRE AGREEMENT
This Warranty, together with the MitoCollar™ Terms & Conditions of Use, constitutes the entire agreement between you and Erchonia regarding warranty coverage for the Device and supersedes all prior or contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding such subject matter. No modification of this Warranty shall be binding unless in writing and signed by an authorized representative of Erchonia.
